after my husbands dad died in 1972 my husband was willed half the land and half the home it sits on. when my husband turned 17 his mother paid him 1500 to sign over to her his part of the land and home. and now he regrets doing so. what can he do? the mother is still alive. could his age be a factor here?

Yes, because she couldnt make a legal contract with a minor.

Well, you usually have to be 18 to enter into a contract - even verbal. He should talk to a lawyer. It may be too late though. Good luck! :)

What? It's his mothers. Leave it be. At 17, he is unable to sign a legal contract as I understand it.I believe you have to be 18. Is there proof? This sounds really messed up to me. But maybe that's just me. It sounds like really none of your concern. It's not your money.

I don't know if anything can be done after 35 years. However, at the age of 17, he was a minor, and therefore incompetent to sign a contract. The agreement to sell was a contract. Such contracts are voidable (not necessarily void).If there was anything to be done, he should have done something long ago instead of waiting so long.

You would first have to determine what the age of consent is in your state. Then, if he was below the age of consent he cannot legally make a contract. That being the case he should consult with an attorney to determine if a civil suit is in order.
